This closely-watched case represents a significant shift, challenging the long-held legal shield tech companies have relied upon: Section 230 of the Communications Decency Act. The defendants have historically used this law to argue they are not liable for content posted by users. However, this trial focuses not on user content, but on the companies’ own design choices—their algorithms, notification systems, and other features that dictate user experience.
The tech firms deny responsibility, asserting the plaintiff’s evidence does not prove their platforms caused specific harms like depression or eating disorders. They are expected to argue that any alleged injuries stem from third-party users, not the platforms themselves.
A key witness will be Meta CEO Mark Zuckerberg, who is scheduled to testify. In past Congressional testimony, Zuckerberg has stated that scientific research has not established a causal link between social media and worsening youth mental health.
The trial unfolds amid intense global scrutiny. Dozens of U.S. states are separately suing Meta over youth mental health concerns, Australia has banned social media for children under 16, and the UK is considering similar action.
